Maybee vs. Danish -

In this case, plaintiff alleged a violation of the standard of care by treating his small lymphocytic lymphoma with FCR chemotherapy, resulting in severe pancytopenia, pneumonia, sepsis, leading to his death. Plaintiff asserted that Mr. Maybee should have been closely monitored without being given FCR chemotherapy or that he should have been given less aggressive chemotherapy. In closing, plaintiff demanded $900,000.00. The jury deliberated for a half hour and returned a unanimous no-cause verdict. The one question asked of the jury was if defense counsel could be awarded attorney fees.
