It was asserted by the plaintiff that during an open reduction and internal fixation of a Weber B fracture, there was a failure to diagnosis and repair a syndesmosis ligament injury resulting in a permanent and disabling injury to a 45-year old female.  During the six (6) day trial, it was demonstrated using an exacting serial x-ray analysis, that such an assertion was unsubstantiated.  The subsequent repair of the distal anterior tibiofibular ligament was unrelated to the care and treatment of the defendant.  John M. Toth was lead counsel. Robert Hoard second chaired the trial assisted by Zachary Lincoln.
